Service Agreement

1. Parties
This Service Agreement ("Agreement") is entered into between The Local Wedding, a catering service operating under Bakken Hospitality, owned and operated by Josh Bakken, located in Mesa, Arizona ("Company"), and the client identified in the booking confirmation ("Client").
2. Services
The Company agrees to provide wedding catering services as outlined in the Client's booking confirmation, including but not limited to: food preparation, staffing, setup, service during the event, and breakdown. The specific menu, guest count, service style, and event details are confirmed in writing at the time of booking.
Any changes to the agreed scope of services must be requested in writing no later than 14 days prior to the event date and are subject to availability and additional charges.
3. Payment Terms
Deposit: A non-refundable deposit of 50% of the total estimated invoice is required to secure the event date. No date is held without a paid deposit.
Final Balance: The remaining balance is due no later than 14 days prior to the event date. Failure to remit final payment by this deadline may result in cancellation of services at the Company's discretion.
Additional Charges: Any services added on the day of the event, including additional guests, extended service hours, or last-minute menu changes, will be invoiced separately and are due within 7 days of the event.
Accepted Payment Methods: Check, ACH bank transfer, or credit card. A 3% processing fee applies to all credit card payments.
4. Cancellation Policy
Client Cancellation: All deposits are non-refundable. If the Client cancels 30 or more days prior to the event, the deposit is forfeited and no further charges apply. If the Client cancels fewer than 30 days prior to the event, the Client is responsible for 75% of the total contracted amount. Cancellations within 14 days of the event are subject to 100% of the contracted amount.
Company Cancellation: In the unlikely event the Company must cancel due to circumstances beyond its control (force majeure, natural disaster, illness), the Company will provide a full refund of all payments received and will make reasonable efforts to assist the Client in securing alternative catering services.
5. Guest Count
The Client must provide a confirmed final guest count no later than 14 days prior to the event. The Company will prepare food and staff the event based on this confirmed count. Increases to the guest count after this deadline are subject to availability and will incur additional charges. The Company cannot guarantee service quality for guest count increases of more than 10% made within 14 days of the event.
6. Staffing Rates
Staffing is included in the base catering package as outlined in the booking confirmation. Additional staffing requests, extended service hours beyond the contracted time, or events requiring specialized staff (bartenders, carving station attendants, etc.) will be quoted separately.
Overtime: Events extending beyond the contracted service window will be charged at $75 per staff member per hour, billed in 30-minute increments.
7. Delivery & Setup Fees
Delivery and setup fees are determined based on the event location and are included in the booking confirmation. Events located outside of the greater Phoenix metro area (Mesa, Phoenix, Scottsdale, Chandler, Gilbert, Tempe) may be subject to additional travel and logistics fees.
The Client is responsible for ensuring the Company has clear and timely access to the venue for setup and breakdown. Delays caused by restricted venue access may result in additional staffing charges.
8. Venue Requirements
The Client is responsible for ensuring the venue permits outside catering and for obtaining any required permits or licenses. The Company is not responsible for venue-imposed restrictions that affect service delivery. The Client must provide access to a commercial-grade kitchen or preparation area as required by the agreed menu.
9. Food Safety & Liability
The Company adheres to all applicable Arizona Department of Health food safety regulations. The Company is not liable for illness or injury resulting from food that has been left unattended for more than two hours after service, or for food provided by third parties at the same event.
The Client is responsible for disclosing all known food allergies and dietary restrictions no later than 14 days prior to the event. The Company will make reasonable accommodations but cannot guarantee a fully allergen-free environment.
10. Damage & Property
The Client is responsible for any damage to Company equipment, rentals, or property caused by guests or venue staff. The Company is not responsible for damage to the venue or Client property that occurs during the normal course of catering operations.
11. Photography & Marketing
The Company reserves the right to photograph food, presentation, and service for use in marketing materials, social media, and portfolio purposes, unless the Client provides written notice of objection prior to the event.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona. Any disputes arising under this Agreement shall be resolved in Maricopa County, Arizona.
13. Entire Agreement
This Agreement, together with the booking confirmation and any written amendments, constitutes the entire agreement between the parties and supersedes all prior discussions, representations, or agreements. No modification of this Agreement is binding unless made in writing and signed by both parties.
